1. Acceptance of Terms
By accessing or using Raphael AI (raphaelai.art), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service. We may update these terms from time to time, and continued use constitutes acceptance of any changes.
2. Service Description
Raphael AI is an AI image generation platform that provides both free and paid access to multiple AI models. The free tier allows unlimited image generation without registration. Premium features require a Google account and a prepaid balance. We act as an intermediary between you and various AI model providers (OpenAI, Google, Black Forest Labs, ByteDance).
3. User Accounts
To access premium features, you must sign in with a Google account. You are responsible for maintaining the security of your account. You must not share your account credentials or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these terms.
4. Payments & Balance
Premium models require a prepaid balance. You can top up your balance through our payment processor (Creem). All prices are in USD. Your balance never expires. Per-image costs vary by model and resolution — see our Pricing page for current rates. Payments are non-refundable except for unused balance within 14 days of purchase. We reserve the right to change pricing with 30 days notice.
5. Acceptable Use
You agree not to use Raphael AI to: generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or discriminatory; create content that exploits minors in any way; generate content that infringes on intellectual property rights of others; attempt to reverse-engineer, hack, or disrupt our service; use automated tools to abuse the free tier or circumvent rate limits; impersonate other individuals or entities; generate deepfakes or misleading content intended to deceive.
6. Prohibited Content — NSFW & Sexually Explicit Material
The generation of NSFW (Not Safe For Work), sexually explicit, pornographic, nude, semi-nude, or sexually suggestive content is strictly prohibited on Raphael AI. This includes but is not limited to: nude or semi-nude imagery of any kind; sexually explicit or suggestive poses, acts, or scenarios; content depicting undressing, intimate situations, or sexual themes; deepfake or face-swap content of a sexual nature; any content that sexualizes minors. Violations of this policy will result in immediate account suspension and permanent ban. We employ automated content moderation filters across all AI models to detect and block prohibited content. Users who attempt to circumvent these filters will be permanently banned.
7. Content & Intellectual Property
You retain full usage rights to images you generate through Raphael AI, including commercial use. However, you are solely responsible for ensuring your use of generated images complies with applicable laws. We do not claim ownership of your generated images. AI-generated images may not be eligible for copyright protection in all jurisdictions — consult local laws for your specific use case.
8. AI Safety & Content Filtering
All AI models on our platform are equipped with robust NSFW content moderation filters that actively detect and block sexually explicit, nude, and otherwise prohibited content. These filters are mandatory and cannot be disabled by users. We reserve the right to refuse generation of any content that violates our acceptable use policy or our prohibited content policy. Safety filters are applied at both the prompt level and the output level across all models, including open-source models such as Flux. Users who repeatedly attempt to generate prohibited content will have their accounts suspended. We are committed to maintaining a safe and responsible AI image generation platform.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may temporarily suspend service for maintenance, updates, or due to circumstances beyond our control. We are not liable for any losses resulting from service interruptions. AI model availability depends on third-party providers and may change without notice.
10. Limitation of Liability
Raphael AI is provided "as is" without warranties of any kind, express or implied. We are not liable for: any indirect, incidental, or consequential damages; loss of data, profits, or business opportunities; content generated by AI models; actions of third-party service providers; or any damages exceeding the amount you paid us in the 12 months preceding the claim.
11. Privacy
Your use of Raphael AI is also governed by our Privacy Policy. By using our service, you consent to the data practices described in our Privacy Policy. We are committed to protecting your privacy and minimizing data collection.
12. Termination
We may terminate or suspend your access to the service at any time, with or without cause, with or without notice. Upon termination, your right to use the service ceases immediately. Any remaining balance may be refunded at our discretion. You may delete your account at any time by contacting us.
13. Governing Law
These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms or your use of the service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
